LEAVE AND LICENCE AGREEMENT This LEAVE AND LICENCE AGREEMENT ("Agreement") is executed on [DATE] by and between:
1. Suresh Kumar of Landlord correspondence address (PAN: AABCS1234C ) (hereinafter called the "Licensor / Landlord"); AND
2. Priya Sharma of Tenant permanent / home address (PAN: AABCT5678D ) and Co-tenant / joint tenant name (if any) , employed with Acme Technologies Pvt Ltd (for employee accommodation) (hereinafter called the "Licensee / Tenant").
1. Grant of Licence / Lease
The Licensor hereby grants to the Licensee a leave and licence in respect of the residential flat / apartment bearing the address Flat No. 302, 3rd Floor, Prestige Sunrise Tower, 15th Cross, Koramangala 4th Block, Bengaluru – 560 034 (area: 950 sq ft ), semi_furnished with AC (2 units), refrigerator, washing machine, modular kitchen with chimney, water purifier , together with 1 parking space(s) ("Premises"), for a term of 11 months commencing from [START_DATE] and expiring on [END_DATE], for the purpose of residential occupation only.
2. Licence Fee / Rent
The Licensee shall pay to the Licensor a monthly licence fee of ₹0 (Rupees [RENT_IN_WORDS] only), payable on or before the 5th day of each calendar month. Payment shall be made by bank transfer / cheque / UPI to the Licensor.
The monthly licence fee shall be escalated by 5% per annum at the commencement of each renewal term upon renewal.
3. Security Deposit
The Licensee has paid to the Licensor a refundable security deposit of ₹0 (Rupees [DEPOSIT_IN_WORDS] only), the receipt of which the Licensor acknowledges. The deposit shall be refunded to the Licensee, without interest, within 15 days of vacating the Premises, after deducting any amounts due for outstanding rent, utility bills, or damage to the Premises beyond fair wear and tear. The Licensor shall not be entitled to adjust the deposit against the last month's rent without prior written consent of the Licensee.
4. Obligations of the Licensee / Tenant
The Licensee shall:
(a) use the Premises only for residential / personal occupation and not for any unlawful, illegal, or immoral purpose;
(b) not carry out any structural alterations or additions to the Premises without prior written consent of the Licensor;
(c) maintain the Premises in good and tenantable condition and return it in the same condition (reasonable wear and tear excepted) on vacating;
(d) pay all electricity, water, gas, and utility bills in respect of the Premises during the term;
(e) not sub-let, assign, or part with possession of the Premises or any part thereof under any circumstances;
(f) not keep any pets or animals in the Premises;
(g) permit the Licensor or their representative to inspect the Premises on giving at least 48 hours' notice;
(h) comply with all applicable laws, society bye-laws, and local municipal regulations.
5. Obligations of the Licensor / Landlord
The Licensor shall:
(a) ensure the Licensee's quiet and peaceful enjoyment of the Premises during the term;
(b) be responsible for major structural repairs and maintenance of the Premises;
(c) pay all property taxes, municipal taxes, and society charges (other than maintenance charges allocated to the Licensee);
(d) ensure that all electrical and plumbing fittings are in working condition at the commencement of the term;
(e) not disturb or interfere with the Licensee's peaceful possession during the term, except as expressly permitted herein.
6. Lock-in Period and Termination
This Agreement has a lock-in period of three (3) months. During the lock-in period, neither Party shall be entitled to terminate this Agreement without the written consent of the other Party, and early termination shall entitle the other Party to forfeit / claim the equivalent of the lock-in period's rent as liquidated damages.
After the lock-in period, either Party may terminate this Agreement by giving 1 calendar month(s)' written notice. The notice period shall commence from the first day of the month following the date of notice.
Notwithstanding the above, the Licensor may terminate this Agreement immediately upon: (a) non-payment of rent for two consecutive months; (b) use of the Premises for unlawful purposes; or (c) sub-letting without consent.
7. Renewal
On the expiry of this Agreement, it may be renewed by mutual written agreement on such terms and conditions (including revised rent) as the Parties may agree. There is no automatic right of renewal. If no written renewal agreement is executed, the Licensee / Tenant shall vacate the Premises on or before the expiry date.
8. Governing Law
This Agreement is governed by the laws of India, including the Transfer of Property Act 1882 and the applicable State Rent Control Act. Any dispute shall be subject to the jurisdiction of courts at City .
