Are non-compete clauses enforceable in India?

Section 27 of the Indian Contract Act, 1872 says agreements in restraint of trade are void. In practice, Indian courts have often declined to enforce broad post-employment non-competes.

What tends to hold up better: non-solicitation (don't poach staff/clients for a defined period) and confidentiality obligations. Restraints during employment are treated differently from those after it ends.

Have any restraint clause reviewed by a lawyer for your situation. This is general information, not legal advice.
