Non-compete (post-employment)

Attempts to restrain a leaver from competing after the relationship ends.

In plain English

Indian courts generally will NOT enforce a clause stopping someone from working in your industry after they leave (s.27 of the Contract Act) — restraints during employment are different. Most businesses use non-solicitation instead. Take legal advice before relying on this.

Relevant law

  • Indian Contract Act, 1872 (s.27)
